Article 1 – General Terms and Conditions

The following General Terms and Conditions apply to the sale of all items found on the website of www.merchgrounds.com.

Article 2 – Applicable Law

The agreement and these general terms and conditions are exclusively governed by Dutch law.

Article 3 – Order / Delivery

  1. The purchase and sale agreement is established at the moment you accept the offer and meet the associated conditions.
  2. If you have accepted the offer electronically, Merch Grounds will confirm the receipt of the acceptance of the offer electronically. As long as this acceptance has not been confirmed, you can dissolve the agreement.
  3. Each order is confirmed by Merch Grounds via email as soon as possible.
  4. We strive to deliver the ordered product within 24 hours on working days.
  5. If this is not possible because the item is temporarily out of stock, there is another reason for delay, or an order cannot be executed or can only be partially executed, you will be notified within 24 hours on working days. An alternative will be offered or the money will be refunded.
  6. The ordered item will be sent by mail to the delivery address. The item will be offered for the first time within 2 working days. Delivery takes place at the moment the product is received by (or on behalf of) you. If you are not present at the time of delivery, the order will be offered a second time. If you are also not present the second time, you can collect the package at the nearest postal office. If you receive incorrect or unordered items, please notify Merch Grounds as soon as possible. Any inaccuracies will then be resolved by Merch Grounds.
  7. Any inaccuracies in the information provided by Merch Grounds to you should be reported immediately to Merch Grounds, as well as any changes or inaccuracies in the information you provided to Merch Grounds.
  8. The item remains the property of Merch Grounds until it is fully paid. Merch Grounds reserves the right to delivery. The ownership of delivered products only transfers to you after you have fulfilled everything you owe to Merch Grounds under any agreement.

Article 4 – Prices / Payment

  1. The prices of the items are indicated in euros and are the prices applied at the time of purchase.
  2. All prices are inclusive of VAT and exclusive of handling and shipping costs, unless otherwise stated or agreed in writing.
  3. Offers are valid as long as stock lasts. Merch Grounds is not bound to its offer if there are (programming) errors on its website.
  4. Offers and prices are guaranteed. Merch Grounds expressly reserves the right to change prices, especially when required by (legal) regulations.
  5. You can pay for items from Merch Grounds via iDeal, Debit/Credit Card or Paypal. For debit / credit card payments, we accept Visa, MasterCard, and Maestro. Paying via iDeal means you pay through your own home banking system.
  6. Merch Grounds is not responsible for any additional bank charges.
  7. In some cases, additional information may be requested.
  8. The order confirmation will be sent to your email. It is therefore important that you provide the correct email address. Via the order confirmation, Merch Grounds indicates that the order procedure was successful and that the order has been received.

Article 5 – Returns and Service

  1. You have a reflection period of 14 days from the day of delivery of the order. We recommend that you inspect the delivered goods upon receipt.
  2. During this period, you must handle the product and packaging carefully. If you make use of the right of withdrawal, the product must be returned to Merch Grounds in its original packaging.
  3. If an item is visibly used, such as opened boosters/boxes, Merch Grounds will not accept the item back.
  4. After receipt and inspection of the return shipment, you will be notified by email. The purchase amount will be refunded by Merch Grounds within 14 days after receipt of the email.
  5. If you are not satisfied with a product and/or service, please contact us as soon as possible by email. We will respond to your complaint as soon as possible.
  6. Despite our utmost care and control, it may happen that you discover a material or production error after purchase. In that case, you can return the order within 14 days free of charge. Please contact us for this.
  7. In case of a refund, Merch Grounds will return the amount you paid to the used bank account within 14 days after the return shipment.
  8. Use the return address as mentioned in our Refund Policy page. The costs for returning purchases are at your own expense.

Article 6 – Warranty

Merch Grounds offers a warranty on online purchases. This period starts from the date of purchase. A complaint will be processed when photos of the complaint(s), a photo of the entire package are sent to merchgrounds@gmail.com. Merch Grounds determines whether the warranty applies and establishes the method of repair and/or shipment. Once the complaint is valid and you send the item to be replaced, it must be provided with packaging that prevents transport damage. Note: you need the purchase receipt to request a warranty.

Article 7 – Privacy Policy

  1. Merch Grounds respects the privacy of all users of its site and ensures that personal information is treated confidentially. We use your data to make orders run as smoothly as possible. For the rest, we will only use this data with your permission. Merch Grounds will not provide personal data to third parties.
  2. Your personal data is included in our customer database. Your data is used for the assessment, conclusion, and execution of the delivery agreement and the management of the resulting customer relationship, such as carrying out marketing activities by Merch Grounds, collection of due amounts, fraud prevention, and compliance with legal obligations. Merch Grounds does not provide data to third parties that would compromise your privacy. If you no longer wish to receive commercial offers from us, it is possible to unsubscribe after each mailing you receive.

Article 8 – Changes / Provisions

  1. The version of the General Terms and Conditions that applied at the time the agreement was concluded is always applicable, unless the buyer has accepted the application of a revised version of the General Terms and Conditions after the conclusion of the agreement.
  2. Without prejudice to its other rights, Merch Grounds reserves the right, in case of circumstances beyond its control, to either suspend the execution of your order or to dissolve the agreement without judicial intervention. This will be communicated to you in writing, and Merch Grounds will not be obliged to pay any compensation, unless this would be unreasonable or unfair under the given circumstances.
  3. Circumstances beyond its control include, but are not limited to, any event that prevents Merch Grounds from fulfilling its obligations and cannot be attributed to its fault. This includes natural disasters, strikes, illness among staff, disruptions in transportation, import/export bans, and other unforeseen events that prevent normal business operations, whether these occur at Merch Grounds or its suppliers.
